can I sue for malpractice and negligence?

My doctor misdiagnosed me and almost gave me a surgery that would have prevented me from having the ability to find the real diagnosis. And I called his emergency phone number 20 times and no phone calls were returned, which resulted in having the go to the emergency room. THIS IS HOW IT HAPPENED….

I have been suffereing from bladder problems for about 5 years. I started seeing a Urologist 1 year ago. He prescribed me medication for IC, overactive bladder, pyridium, percocet, and other medications to see which worked for my bladder. None worked. He performed a cystoscopy bladder distention and looked for cancer, bacteria, and stones. He discharged me as finding nothing. Lastly, he did a temporary surgery called interstim neuro modulation. He took the wires out of me and scheduled me to have a permanent interstim surgery a week later. I went to the appointment to have the permanent surgery, and found out I had a bladder infection. He postponed my surgery for 15 days later and dischaged me with antibacterial medicine to heal the bladder infection. 2 days later I woke up in the middle of the night with severe abdonminal pain. I went to the emergency room and they found blood in my urine. They asked me "have you ever had a catscan done?" I say "no". They said they were going to do one. They did one and found "multiple stones and lacerations" in my bladder. They said that my doctor misdiagnosed me and I needed to get the bladder stones removed before I got the interstim neuro modulation surgery done. Also, having the interstim surgery would have prevented me from finding the bladder stones because people are not allowed to recieve a catscan after recieving this surgery due to having wires in their spine. They discharged me and told me to follow up with my urologist. The same day, I called my urologist and told him what happened and he acted surprised and said he wanted to see me that day for an emergency appointment. I agreed to come in. However, I was delayed 24 hours because I had to go pick up my medical records of my catscan. So, I called him back and the staff said he was "on a vacation until next friday." I called his emergency after hours line and NOBODY would return my call. SO I went back to the emergency room and they reffered me to a different urologist within the next buisness day. I have records of everything kept. SHOULD I SUE? HOW MUCH IS IT WORTH?

    This is worth nothing.

If I understand correctly, you ALMOST suffered incurable damage. You WOULD HAVE suffered incurable damage had the doctor proceeded with the interstim thing. However, in the end, everything was correctly diagnosed & you are having your bladder stones removed.

Here’s the deal. You do not have a case if there are no damages. ALMOST literally means NOTHING. You do not get anything for ALMOST being hit by a car, or ALMOST being burned by a cup of coffee, or ALMOST slipping and falling in a grocery store. Likewise, you get nothing for ALMOST having an incurable bladder stone condition.

You can sue anyone for anything. Whether you collect is another story. Suing doctors is popular because they have insurance. Misdiagnosis is difficult to prove.

you havent suffered any damage physically which is what they base their judgement on. If you had had the procedure then you might have a case. Guess if your other symtomatology suggested stones after the interstim, they just would have had to reverse that and check for stones.

Maybe - talk to an attorney or file a a report on him through your state’s medical board
